DMCA Policy for Gaming Platform Issues
Gaming Platform Issues ("we," "us," or "our") is committed to respecting the intellectual property rights of others and expects our users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines our procedures for addressing alleged copyright infringement on our platform.
The DMCA provides a mechanism for copyright holders to request the removal of content that they believe infringes their copyright. It also provides a process for users whose content has been removed to submit a counter-notification if they believe the content was removed by mistake or misidentification.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content on our platform infringes upon your copyrights, you may submit a written DMCA Notice of Infringement to our designated Copyright Agent. Your notice must include substantially the following:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the Infringing Material: A description of the material that you claim is infringing and needs to be removed or access to which needs to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) of the specific game, user-generated content, or forum post).
- Contact Information: Your name, address, telephone number, and email address.
- Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Upon receipt of a valid DMCA Notice, we will promptly investigate and take appropriate action, which may include removing or disabling access to the alleged infringing material.
Filing a DMCA Counter-Notification
If you believe that material you posted on our platform was removed or access to it was disabled by mistake or misidentification of the material, you have the right to submit a DMCA Counter-Notification. Your counter-notification must include substantially the following:
- Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
- Statement of Good Faith Belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Gaming Platform Issues may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Physical or Electronic Signature: Your physical or electronic signature.
Upon receipt of a valid DMCA Counter-Notification, we will provide a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against you within 10-14 business days, we may, in our sole discretion, replace or restore access to the removed material.
